Terms of Service

Effective September 15, 2026 · agentswiftly.com

These Terms govern your use of this website. Services are performed under a signed service agreement, which controls where it differs from these Terms.

1. About these terms

These Terms of Service ("Terms") govern your use of the agentswiftly.com website and any title operations support services provided by Agent Swiftly ("Agent Swiftly," "we," "us," or "our").

By using this website or engaging Agent Swiftly for services, you agree to these Terms. If you are acting on behalf of a company, you represent that you have authority to bind that company.

Services themselves are governed by the specific written agreement (such as a service agreement or statement of work) signed between you and Agent Swiftly. Where a signed agreement conflicts with these Terms, the signed agreement controls.

2. Our services

Agent Swiftly provides operational support services to title insurance and real estate closing companies, including title production support, closing support, and post-closing support.

The scope, timing, pricing, and deliverables of any services are defined in the applicable service agreement or statement of work. Descriptions on this website are informational and do not by themselves create a contract.

3. Use of this website

You may use this website for lawful purposes only. You agree not to misuse the website, attempt to gain unauthorized access to it, interfere with its operation, or use it to transmit unlawful, harmful, or misleading content.

The website, including its text, design, graphics, and logo, is owned by Agent Swiftly and protected by applicable intellectual property laws. You may not reproduce or reuse website content for commercial purposes without our written permission.

4. Client responsibilities

When you engage Agent Swiftly, you agree to provide accurate information about the work requested, timely access to the systems, files, and instructions needed to perform the work, and a point of contact for questions and escalations.

You are responsible for determining that outsourced work is permissible under your own agreements, including any agency agreements with your underwriters, and for maintaining required licenses and compliance obligations for your business.

5. Confidentiality

We understand that title work involves sensitive client, transaction, and property information. Information you share with us for the purpose of performing services is treated as confidential, used only to provide those services, and protected by the confidentiality provisions of your service agreement.

Upon completion or termination of an engagement, we will return or securely dispose of client materials as specified in your service agreement.

6. Disclaimers

This website is provided "as is" without warranties of any kind. We do not guarantee that the website will be uninterrupted, error-free, or free of harmful components.

Nothing on this website constitutes legal, financial, or professional advice. Title practices and requirements vary by state, underwriter, and transaction; you remain responsible for the accuracy and compliance of the final work products you deliver to your customers.

Except as expressly stated in a signed service agreement, Agent Swiftly disclaims all liability arising from use of this website or reliance on its contents.

7. Limitation of liability

To the maximum extent permitted by law, Agent Swiftly's total liability arising from these Terms or your use of this website is limited to one hundred U.S. dollars (USD $100).

Agent Swiftly will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, or data loss, arising from use of this website.

Liability for services is governed exclusively by the applicable signed service agreement.

8. Termination

We may suspend or terminate access to the website at any time for conduct that we believe violates these Terms or is harmful to other users or to us.

Engagements may be ended as provided in the applicable service agreement.

9. Changes

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.

10. Governing law and contact

These Terms are governed by the laws of the United States and the state in which Agent Swiftly maintains its principal place of business, without regard to conflict-of-law rules.
